The property is legally existing non-conforming with regard to the side yard setbacks and lot size and pursuant to §235-9(B) of the Table of Dimensional regulations of the Town/Village of Harrison the minimum required side yard setback is 20 feet. The proposed pergola to be installed at the rear of the house increases this non-conformity with a proposed side yard setback of 10.4 feet thus requiring a variance of 9.6 feet.

 

CAL. Z12-014   MARY LOU & MARK MANUS – 3 Sky Meadow Farm, Block 611, Lot 63 – This property is located in an R-2.5 Zoning District and pursuant to §235-9(B) Table of Dimensional regulations of the Town/Village of Harrison Accessory Structures require a 75 foot setback from the front property line. The existing Pool House encroaches into the setback 60.10 feet thus requiring a 14.2 foot variance. The existing Tennis Court encroaches into the setback 62 feet thus requiring a variance of 13 feet. The existing Swimming Pool encroaches into the setback 60.10 feet thus requiring a variance of 14.2 feet. The existing Pool Equipment encroaches into the setback 52.6 feet thus requiring a variance of 22 feet.

 

CAL. Z12-015   ROBERT & JENNIFER POMROY – 1 Timber Trail, Block 601, Lot 49 – This property is located in the more restrictive R-1 Zoning District with regard to the minimum required front yard setback of 50 feet and a minimum side yard setback of 50 feet. The property is also located on a corner lot abutting a side street. Pursuant to §235-26 (C)(1) of the Zoning Ordinance of the Town/Village of Harrison no fences located in the front yard shall have a height greater than 4 feet. The proposed fence is indicated to have a height of 6 feet along the front property lines at Timber Trail and Polly Park Road therefore a variance of 2 feet is required.
